Welcome to the ERISA Disability Benefits Blog on the erisadisabilitybenefits.com website. The purpose of this website is to provide information about legal rights when denied long-term disability benefits from an insurance company. My name is Greg Paul and I am an attorney who saw the need for helping people over sixteen years ago who could not find an ERISA attorney. 

The first question a client needs to ask is:
How much time do I have to appeal?
  • 180 days to appeal the first denial from your insurance company
 
How much time do I have to file a lawsuit under ERISA?
  • ERISA is a federal law but does not provide a statute of limitations for the denial of benefits. For this reason, courts will apply either the time limit set forth in the insurance policy (often 1 or 3 years) or the most similar state law such as for breach of contract that varies from state to state (often 1 year on up).
